Official Rules Page
These rules govern the KOLR10 KOZL Ozarks Local Tech Toy Thursday (the “Promotion”) being conducted by KOLR10 & KOZL (collectively, the “Administrators”) and sponsored by KOLR(TV), KOZL-TV(collectively, the “Media Sponsors”), which will begin on or around 12:01am Central Time (“CT”) 1/30/12. Drawings for the contest will occur every Thursday on the following dates at approximately 5:00pm on 2/2/12Kindle Fire, 2/9/12 IPad2, 2/16/12 Kindle Fire, 2/23/12 IPad2,3/1/12 Kindle Fire, 3/8/12 IPad2, 3/15/12Kindle Fire, 3/22/12 IPad2, 3/29/12 Kindle Fire, 4/5/12 IPad2, 4/12/12 Kindle Fire, 4/19/12 IPad2, 4/26/12 Kindle Fire,5/3/12 IPad2, 5/10/12 IPad2, 5/17/12 IPad2, 5/24/11 IPad2.
No purchase or payment necessary to enter or win. A purchase or payment will not increase a chance of winning. One valid entry, per contestant.
Entry Conditions
The registered user must live in the 31 counties in our designated market area and must be at least 18 years of age except for employees of Sponsors, their licensees, and each of their respective parent, subsidiary and affiliated entities, Sponsors’ advertising and promotional agencies, other television and radio stations in the Springfield, MO metropolitan area, the members of their immediate families (spouse, parent, sibling or child) and those living in the same household of each (whether related or not), are ineligible to enter or win. This Promotion is subject to all applicable federal, state and local laws and regulations and is void where prohibited.
To participate in the Promotion, log onto http://ozarksfirst.upickem.net/engine/Welcome.aspx?contestid=50492 or link to it via any Sponsor webpage, and follow the links and instructions to enter the Promotion and submit your first name and last name, complete address, city, state, zip code, telephone number, date of birth and a valid email. Once an account is created, the registered user must "LIKE" our Facebook page. Entries may be received between January 30, 2012 and May 24, 2012.
One entry per person. Multiple entries will be disqualified.
Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the email address by an internet access provider, online service provider or other organization that is responsible for assigning an email address or the domain associated with the submitted email address. Multiple participants are not permitted to share the same email address. Entries submitted will not be acknowledged or returned. no purchase necessary.
Winner Selection
A winner will be chosen by random drawing each Thursday at 5:00PM between [first Thursday and last Thursday]
We will post the winner's name on the KOZL Ozarks Local 9PM News and the KOLR10 10PM News on the Thursday night of each drawing. The winner also will be notified by a station employee of the winning the Friday after the drawing.
Odds of winning depend on the number of entries received.
Winner must take delivery of the IPAD2 or Kindle Fire from KOLR10, KOZL Ozarks Local within thirty (30) days of winning or winner forfeits prize. Winner will be required to sign standard prize form and show current identification as the winner in order to take possession of the prize.
Prizes
The prize given away each Thursday is a IPAD2 or Kindle Fire [how do you know whether you are winning the ipad or the kindle fire?], The winner will be solely responsible for all taxes and all other fees and expenses not specified herein associated with the receipt and use of the prize, including but not limited to the data plan to operate the IPAD2 or Kindle Fire, license and registration fees, freight, delivery, additional equipment, all federal, state and local taxes. The Sponsors accept no responsibility for repairing any real or supposed damage to any prize. Prize is provided “as-is.”

General:
Use of any device to automate entry or votes is prohibited and Administrators reserve the right to disqualify any entrant(s), nominated teacher(s) or votes they reasonable suspect having been made through an automation process. Proof of submission of an entry shall not be deemed proof of receipt by Administrators. Administrators’ computer is the official time keeping device for the Promotion. Sponsors are not responsible for entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties and other technological problems.
KOLR10, KOZL and Ozarksfirst.com reserve the right to use any and all information related to the Contest, including information on contestants obtained through the contest, for marketing purposes or any other purpose, unless prohibited by law.
Entrants are required to provide truthful information and the Station will reject and delete any entry that it discovers to be false or fraudulent. The Administrators will disqualify any entry from individuals who do not meet the eligibility requirements. The Administrators will also delete any entry knowingly received from persons under the age of 18 in compliance with the Children’s Online Privacy Protection Act.
.Winner acknowledges and agrees that the Media Sponsors are not acting as the manufacturer(s) or distributor(s) of the prize. The Media Sponsors, acting as a consumer, acquired the prize for the purpose of awarding the prize to a winner in the Promotion. With respect to any claims winner may have as a result of the possession or use of the prize, winner shall look solely to the prize provider, prize manufacturer or others in the chain of production and distribution of the grand prize excluding the Media Sponsors and any of their related or affiliated entities. The Media Sponsors have not made and are not responsible in any manner for any warranties, or guarantees, express or implied, in fact or law, relating to the Prize, including without limitation, its quality, mechanical condition, merchantability, or fitness for a particular purpose, with the exception of any standard manufacturer's warranty that may apply to the prize,and not the Media Sponsors, or any supplemental warranties which the winner may purchase from manufacturer and which is not the responsibility of the Station.
The winners will be solely responsible for all taxes and all other fees and expenses not specified herein associated with the receipt and use of any Prize. The Station accepts no responsibility for repairing any real or supposed damage to any prize.
All prizes or prize certificates may be picked up at the office of the Station at the address below. The winner will forfeit any prize or prize certificate not claimed within thirty (30) days of winning. No prizes will be mailed. Sponsors are not responsible for the safe arrival of a prize or prize certificate.
There is no substitution, transfer or cash equivalent for prizes, except that the Sponsors may, at its sole discretion, substitute prizes or cash of comparable value. The prizes are expressly limited to the item(s) listed above and unless otherwise expressly specified, do not include taxes, gratuities or any other expenses. Other restrictions may apply.
Decisions of the Sponsors with respect to the Promotion are final.
Payments of all federal, state and local taxes are solely the responsibility of the winner. The winner will be required to complete and submit an IRS Form W-9 with the winner’s full Social Security Number or the equivalent for receipt of any prize valued at $100 or more or for any prizes awarded by the Administrator (or any other Media Sponsor) in a calendar year with an aggregate value of $100 or more. Failure to submit a complete W-9 or equivalent will result in forfeiture of the prize. Such winnings of $100 or more will be reported to the IRS.
By participating in the Promotion, the winner agrees to have the winner’s name, voice and likeness used in any advertising or broadcasting material relating to the Promotion by the Sponsors without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize. Winner name and picture will be posted on the contest form and online in Administrator’s Entertainment section of Ozarksfirst.com and on our KOLR10 and KOZL Ozarks Local Facebook page.
Prior to awarding any prize or prize certificate, the Sponsors, in their sole discretion, may require Promotion Winner to sign a liability release, agreeing to release and hold harmless the Sponsors, their licensees, the licensees’ parent, subsidaries and affiliated entities, their respective officers, shareholders, directors, employees, agents and representatives and all of their successors and assigns from and against any and all claims or liability arising directly or indirectly from the prize and participation in the Promotion.
If for any reason this Promotion cannot be executed as planned, including, but not limited to, as a result of infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsors that corrupt or affect the security, administration, fairness, integrity or proper conduct of the Promotion, or if the Promotion is compromised or becomes technically corrupted in any way, electronically or otherwise, the Sponsors reserves the right to cancel, terminate or modify the Promotion. If the Promotion is terminated before the original end date, the Sponsors will select the winners by random drawing from among all eligible non-suspect entries received as of the termination time/date.
e.The Administrators, in their sole discretion, reserve the right to disqualify any person tampering with the entry process or the operation of the Promotion’s website. Failure to comply with the rules of the Promotion may result in a contestant’s disqualification and/or forfeiture of any prize or prizes. If the Administrators make a good faith determination that an entrant,or participant has cheated or committed fraudulent activity in connection with a Promotion, the Administrators reserve the right to disqualify an entrant, or others from entering and/or winning future Promotions and to prosecute and seek damages to the fullest extent permitted by law.
f.The Administrators reserve the right to make changes in the rules of the Promotion, including, without limitation, the substitution of a prize of equivalent value, which will become effective upon announcement. If due to circumstances beyond the control of the Administrators, any competition or prize-related event or travel is delayed, rescheduled, postponed or cancelled, the Administrators reserves the right, but not the obligation, to cancel or modify the Promotion and shall not be required to award a substitute prize.
g.The Promotion and all of the related pages, contents and code are copyright, UPICKEM, Inc., the Sponsors and/or media sponsors. Copying or unauthorized use of any copyrighted materials, trademarks or any other intellectual property without the express written consent of its owner is strictly prohibited.
h.UPICKEM, the Sponsors, and Ozarksfirst.com / media sponsors are not responsible for Internet crashes or slowdowns caused by network congestion, viruses, sabotage, satellite failures, phone line failures, electrical outages, natural disasters or acts of man or God.
i.All results posted are unofficial until winners respond to e-mail notification.
j.This contest is not intended for gambling. If it is determined that a contestant is using the contest for gambling purposes they will be disqualified and reported to authorities.
k.The Sponsors not responsible for typographical or other errors in the printing, the offering or the administration of the Promotion or in the announcement of a prize.
