How To Enter
a.These rules govern the Springfield Imports / Volkswagen of Springfield Teachers Free Ride Contest (the “Promotion”) being conducted by KOLR10 & KOZL (collectively, the “Administrators”) and sponsored by KOLR(TV), KSFX-TV, KRVI(FM), KSGF(AM), KSGF-FM, KSPW(FM), and KTTS-FM (collectively, the “Media Sponsors”) and Springfield Imports/Volkswagen of Springfield (collectively, with the Media Sponsors, the “Sponsors”), which will begin on or around 12:01am Central Time (“CT”) contest #1 8/29/11 and will end at approximately 11:59pm CT on October 3, 2011. Contest #2 10/24/11 and will end at approximately 11:59pm CT on January 16, 2012. Contest #3 3/12/12 and will end at approximately 11:59pm CT on April 16, 2012. Contest #4 6/4/12 and will end at approximately 11:59pm CT on July 9, 2012.
b.To participate in the Promotion, you may log onto http://ozarksfirst.upickem.net/engine/Welcome.aspx?contestid=37135 or link to it via any Sponsor webpage, and follow the links and instructions to enter the Promotion and submit during contest 1 8/29/11-9/30/11, contest 2 10/24/11-1/6/12, contest 3 3/12/11-4/6/12, contest 4 6/4/12-6/29/12 your first name and last name, complete address, city, state, zip code, telephone number, date of birth and a valid email address, the name, grade, phone number, email address and school of the teacher you would like to nominate and a brief, original statement of up to 100 words (“Statement”) as to why you think that teacher should win. Only one internet nomination/entry per person and one internet entry per email address is permitted. The teacher must serve the 31 counties in our designated market area. Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the email address by an internet access provider, online service provider or other organization that is responsible for assigning an email address or the domain associated with the submitted email address. Multiple participants are not permitted to share the same email address. Entries submitted will not be acknowledged or returned. Use of any device to automate entry or votes is prohibited and Administrators reserve the right to disqualify any entrant(s), nominated teacher(s) or votes they reasonable suspect having been made through an automation process. Proof of submission of an entry shall not be deemed proof of receipt by Administrators. Administrators’ computer is the official time keeping device for the Promotion. Sponsors are not responsible for entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties and other technological problems.
c.The teacher with the most votes will be the winner to drive the 2012 Passat for 11 or 13 weeks. Contest 1 voting period is 9/26/11-9/30/11. Contest 2 voting period is 1/9/12-1/13/12. Contest 3 voting period is 4/9/12-4/13/12. Contest 4 voting period is 7/2/12-7/6/12.
d.Each submitted Statement must be the original and creative work of each entrant and must not contain copyrighted materials or any other materials that may be restricted, prohibited or outlawed by federal, state or local laws. Administrators have the absolute discretion to disqualify any entry based on the content of the Statement in their sole judgment. Administrators, in their sole discretion, reserve the right to disqualify any Statement if such Statement contains illegal, indecent or otherwise offensive material, or if such Statement contains material whose content is deemed at the sole discretion of Administrators to be unsuitable for the public (i.e. Statement must be broadcast clean). All entrants must agree to the Station’s online submission release in order to submit his or her entry. Statements that do not comply with these rules will not be eligible for the Contest.
e.Springfield Imports / Volkswagen of Springfield, KOLR10, KOZL , Ozarksfirst.com, KTTS, Power 96.5, News Talk KSGF, 106.7 The River, Buy Local Ozarks and Journal Broadcast Group reserve the right to use any and all information related to the Contest, including information on contestants obtained through the contest, for marketing purposes or any other purpose, unless prohibited by law.
ELIGIBILITY RESTRICTIONS
a.The Promotion is open to all persons who are 18 years of age or older and who reside in Missouri in the metropolitan Springfield Area. Employees of Sponsors, their licensees, and each of their respective parent, subsidiary and affiliated entities, Sponsors’ advertising and promotional agencies, other television and radio stations in the Springfield, MO metropolitan area, the members of their immediate families (spouse, parent, sibling or child) and those living in the same household of each (whether related or not), are ineligible to enter or win. This Promotion is subject to all applicable federal, state and local laws and regulations and is void where prohibited.
b.Entrants are required to provide truthful information and the Station will reject and delete any entry that it discovers to be false or fraudulent. The Administrators will disqualify any entry from individuals who do not meet the eligibility requirements. The Administrators will also delete any entry knowingly received from persons under the age of 18 in compliance with the Children’s Online Privacy Protection Act.
PRIZES
a.One prize will be awarded. The prize is a three (3) month lease per quarter during each contest, from 4/6/12 to 6/30/12, of a 2012 Volkswagen Passat, with standard features such as automatic transmission; power windows and locks; airbags; air conditioning; radio with CD player, courtesy of Volkswagen of Springfield/Springfield Imports. The ARV of the prize is [INSERT AMOUNT]. The winner will be solely responsible for all taxes and all other fees and expenses not specified herein associated with the receipt and use of the prize, including but not limited to title, license and registration fees, freight, delivery, dealer prep, additional equipment, all federal, state and local taxes, gasoline, vehicle maintenance, insurance and all other fees and expenses associated with the receipt of the prize vehicle. The Sponsors accept no responsibility for repairing any real or supposed damage to any prize. Prize is provided “as-is.” Interior and exterior color of the prize vehicle will be determined by Volkswagen of Springfield/Springfield Imports. Any additional car options (including the interior and exterior color of the prize) not specified herein is subject to availability and will be the responsibility of the winner.
b.Winner will also receive certificates/vouchers for $500 dollars ($500.00) worth of gasoline from Price Cutter.
c.Winner must qualify for required automobile insurance and present evidence of such insurance prior to accepting delivery of the prize. Prize winner (or prize winner’s co-signer(s)) must also pass a standard credit inspection. Credit approval is required to receive the vehicle lease. The vehicle lease prize winner must provide valid government-issued photo identification, including a valid driver’s license, and provide their complete address, date of birth, and phone number to claim a prize.
d.Winner must take delivery from Volkswagen of Springfield/Springfield Imports within __ (_) days of winning or winner forfeits prize. Winner will be required to sign standard closed end motor vehicle lease in order to take possession of the prize vehicle. To extent the terms of such closed end vehicle lease conflict with any terms or conditions of these rules, the terms and conditions of the closed end vehicle lease shall control. Limit ____miles (__) miles during the three month lease term. Winner will be solely responsible for additional mileage charges above ______ miles at the rate of ____ cents ($.__) per mile. Winner will also be responsible for any damage to the vehicle beyond normal wear and tear.
e.Winner acknowledges and agrees that the Media Sponsors are not acting as the manufacturer(s) or distributor(s) of the prize. The Media Sponsors, acting as a consumer, acquired the prize for the purpose of awarding the prize to a winner in the Promotion. With respect to any claims winner may have as a result of the possession or use of the prize, winner shall look solely to the prize provider, prize manufacturer or others in the chain of production and distribution of the grand prize excluding the Media Sponsors and any of their related or affiliated entities. The Media Sponsors have not made and are not responsible in any manner for any warranties, representations, or guarantees, express or implied, in fact or law, relating to the Prize vehicle, including without limitation, its quality, mechanical condition, merchantability, or fitness for a particular purpose, with the exception of any standard manufacturer's warranty that may apply to the vehicle, which is provided by Volkswagen of Springfield/Springfield Imports and not the Media Sponsors, or any supplemental warranties which the winner may purchase from Volkswagen of Springfield/Springfield Imports and which is not the responsibility of the Station.
f.The winners will be solely responsible for all taxes and all other fees and expenses not specified herein associated with the receipt and use of any Prize. The Station accepts no responsibility for repairing any real or supposed damage to any prize.
g.All prizes or prize certificates may be picked up at the office of the Station at the address below. The winner will forfeit any prize or prize certificate not claimed within _____ (__) days of winning. No prizes will be mailed. Sponsors are not responsible for the safe arrival of a prize or prize certificate.
h.There is no substitution, transfer or cash equivalent for prizes, except that the Sponsors may, at its sole discretion, substitute prizes or cash of comparable value. The prizes are expressly limited to the item(s) listed above and unless otherwise expressly specified, do not include taxes, gratuities or any other expenses. Other restrictions may apply.
WINNER SELECTION AND NOTIFICATION
a.Decisions of the Sponsors with respect to the Promotion are final.
b.During the period between 9:00 AM, CT on April 9, 2012 and 9:00AM, CT on April 13, 2012 the viewers and listeners of the Media Sponsors will be encouraged to log on to http://ozarksfirst.upickem.net/engine/Welcome.aspx?contestid=37135 and vote for their favorite teacher. The teacher that receives the most votes will, subject to confirmation of eligibility and acceptance of the prize, win the prize. One (1) vote per person, please.
c.Odds of winning the prize depend upon the number of teachers entered into this Promotion and the number of people voting in this Promotion.
d.The potential winner will be notified by email and contacted by a representative of the Administrators to confirm that they qualify for the prize and want to accept the prize and be the Winner of the Promotion. If within seven (7) days following April 16, 2012: (i) the potential winner cannot be reached; (ii) fails to meet the qualifications of these rules; or (iii) declines the prize, that potential winner will forfeit all prizes, be disqualified, and an alternate potential winner will be selected by picking the next highest teacher with votes.
e.Qualifying winners must execute and return any required Affidavit of Eligibility and/or Release of Liability Prize Acceptance Form and provide any other documents or meet any other requirements or obligations within thirty (30) days of notification or the qualifying winner will forfeit all prizes, be disqualified , and an alternate potential winner will be selected by the next highest voting teacher.
f.If there is a tie in the number of votes among more than one potential winner, the winner will be selected in a random drawing of all tied entries.
CONDITIONS
a.Payments of all federal, state and local taxes are solely the responsibility of the winner. The winner will be required to complete and submit an IRS Form W-9 with the winner’s full Social Security Number or the equivalent for receipt of any prize valued at $600 or more or for any prizes awarded by the Administrator (or any other Media Sponsor) in a calendar year with an aggregate value of $600 or more. Failure to submit a complete W-9 or equivalent will result in forfeiture of the prize. Such winnings of $600 or more will be reported to the IRS.
b.By participating in the Promotion, the winner agrees to have the winner’s name, voice and likeness used in any advertising or broadcasting material relating to the Promotion by the Sponsors without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize. Winner name and picture will be posted on the contest form and online in Administrator’s Entertainment section of Ozarksfirst.com.
c.Prior to awarding any prize or prize certificate, the Sponsors, in their sole discretion, may require Promotion Winner to sign a liability release, agreeing to release and hold harmless the Sponsors, their licensees, the licensees’ parent, subsidiary and affiliated entities, their respective officers, shareholders, directors, employees, agents and representatives and all of their successors and assigns from and against any and all claims or liability arising directly or indirectly from the prize and participation in the Promotion.
d.If for any reason this Promotion cannot be executed as planned, including, but not limited to, as a result of infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsors that corrupt or affect the security, administration, fairness, integrity or proper conduct of the Promotion, or if the Promotion is compromised or becomes technically corrupted in any way, electronically or otherwise, the Sponsors reserves the right to cancel, terminate or modify the Promotion. If the Promotion is terminated before the original end date, the Sponsors will select the winners by random drawing from among all eligible non-suspect entries received as of the termination time/date.
e.The Administrators, in their sole discretion, reserve the right to disqualify any person tampering with the entry process or the operation of the Promotion’s website. Failure to comply with the rules of the Promotion may result in a contestant’s disqualification and/or forfeiture of any prize or prizes. If the Administrators make a good faith determination that an entrant, nominated teacher, or other participant has cheated or committed fraudulent activity in connection with a Promotion, the Administrators reserve the right to disqualify an entrant, nominated teacher, or others from entering and/or winning future Promotions and to prosecute and seek damages to the fullest extent permitted by law.
f.The Administrators reserve the right to make changes in the rules of the Promotion, including, without limitation, the substitution of a prize of equivalent value, which will become effective upon announcement. If due to circumstances beyond the control of the Administrators, any competition or prize-related event or travel is delayed, rescheduled, postponed or cancelled, the Administrators reserves the right, but not the obligation, to cancel or modify the Promotion and shall not be required to award a substitute prize.
g.The Promotion and all of the related pages, contents and code are copyright, UPICKEM, Inc., the Sponsors and/or media sponsors. Copying or unauthorized use of any copyrighted materials, trademarks or any other intellectual property without the express written consent of its owner is strictly prohibited.
h.UPICKEM, the Sponsors, and Ozarksfirst.com / media sponsors are not responsible for Internet crashes or slowdowns caused by network congestion, viruses, sabotage, satellite failures, phone line failures, electrical outages, natural disasters or acts of man or God.
i.All results posted are unofficial until winners respond to e-mail notification.
j.This contest is not intended for gambling. If it is determined that a contestant is using the contest for gambling purposes they will be disqualified and reported to authorities.
k.The Sponsors not responsible for typographical or other errors in the printing, the offering or the administration of the Promotion or in the announcement of a prize.
l.For a copy of these Official Rules, send a self-addressed stamped envelope for receipt by 8/29/11 - 9/1/12 to Ozarksfirst.com 2650 E Division Springfield MO 65803. For the names of the prize winners send a self-addressed stamped envelope for receipt within sixty (60) days of contest ending to the above address marked Volkswagen Free Teacher’s Ride - Winner List.” The Official Rules and the Winner List (when completed) shall also be available on Ozarksfirst.com, Entertainment, contest page.
PRIVACY
a.By use of the Promotion’s website or by entering the Promotion through any Media Sponsor’s website, you agree to the website’s Terms of Use Agreement located at Ozarksfirst.com and to the use of your personal information as described in the Privacy Policy located at Ozarksfirst.com.
